Welcome to Beyond Geometry. This website is operated by George Gray, trading as Beyond Geometry, based in Hawke’s Bay, New Zealand. These Terms and Conditions apply to your use of the Beyond Geometry website and to purchases made through the website. By accessing this website, placing an order, or purchasing a product from Beyond Geometry, you agree to these Terms and Conditions. Nothing in these Terms is intended to exclude, restrict, or modify any rights you may have under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable law where those rights cannot legally be excluded.

1. Products

Beyond Geometry designs and sells physical products including Flight Station, as well as selected maker products and digital products that may be offered from time to time. Product photographs, descriptions and specifications are provided as accurately as reasonably possible. However, minor differences may occur between individual products and the photographs shown on the website. Some Beyond Geometry products are produced using processes including 3D printing, laser engraving, natural timber veneers and other small-scale manufacturing techniques. Minor variations in surface finish, layer appearance, wood grain, colour, engraving and material texture are normal and do not necessarily constitute a defect. Natural timber components in particular will vary between individual products, meaning no two units will look exactly identical.

2. Flight Station

Flight Station is a connected electronic aviation display designed to provide aviation enthusiasts with aircraft tracking, weather and related aviation information. Flight Station requires a compatible Wi-Fi internet connection for online functionality. Certain features rely on data supplied by third-party services, including aircraft tracking and weather-data providers. Beyond Geometry does not control these third-party data sources and cannot guarantee that aircraft, weather or other information will always be available, complete, uninterrupted or accurate. Flight Station is intended for informational and recreational use only. It is not certified aviation equipment and must not be used for flight planning, navigation, operational decision-making, air traffic control, or any other safety-critical aviation purpose. Features, interfaces and software may be updated or improved over time.

3. Flight Station Software and Updates

Flight Station contains software developed for Beyond Geometry. Purchase of a Flight Station grants you the right to use the software supplied with the device for your personal use. Ownership of the underlying software, firmware, designs and associated intellectual property remains with Beyond Geometry unless otherwise stated. Flight Station may receive over-the-air software updates. These updates may introduce new features, improve existing functionality, correct faults, improve security, or make other changes to the device. Some functionality may depend on external internet services that can change or become unavailable outside Beyond Geometry's control. Where practical, Beyond Geometry may update the software to maintain or replace affected functionality, but continuous availability of every online feature cannot be guaranteed.

4. Founder Edition

Founder Edition Flight Stations are part of a limited initial production run. Where a Founder Edition includes specific benefits, these will be described on the relevant product page at the time of purchase. Founder Edition availability is limited and purchasing a Founder Edition does not entitle the purchaser to a particular serial number unless specifically agreed before purchase. Any advertised Founder Edition software or feature benefits apply to the original Founder Edition device and are subject to the specific terms stated on the product page.

5. Pre-Orders

Some products may be offered for purchase before they are ready to ship. Where an item is described as a pre-order, any estimated manufacturing, completion or shipping date shown on the website is an estimate rather than a guaranteed delivery date unless expressly stated otherwise. Beyond Geometry will make reasonable efforts to meet published estimates and will communicate significant delays where practicable. Pre-orders may be affected by component availability, manufacturing delays, shipping delays or other circumstances outside Beyond Geometry's reasonable control. Your rights under applicable New Zealand consumer law are not affected by this clause.

6. Pricing and Payment

All prices are displayed in the currency indicated on the website. Orders must be paid using one of the payment methods offered during checkout or, where agreed, by invoice. An order is not confirmed until payment has been successfully received or otherwise accepted by Beyond Geometry. Beyond Geometry reserves the right to correct genuine pricing, product-description or availability errors. If an error affects an order you have already placed, you will be contacted before the order is fulfilled and given appropriate options, including cancellation and refund where applicable. For international orders, customers may be responsible for customs duties, import taxes, GST/VAT, brokerage fees or other charges imposed by the destination country unless the checkout specifically states that these charges are included.

7. Shipping and Delivery

Beyond Geometry ships physical products to New Zealand and selected international destinations. Shipping costs and available delivery options will be displayed or communicated before an order is completed. Delivery estimates are estimates only unless expressly stated otherwise. Delays caused by postal services, couriers, customs processing, weather, international transport or other circumstances outside Beyond Geometry's reasonable control may occur. 8. Returns, Faults and Consumer Guarantees

Beyond Geometry wants products to arrive and operate as intended. If your product arrives damaged, develops a fault, is not as described, or otherwise fails to meet a guarantee that applies under New Zealand law, please contact Beyond Geometry as soon as reasonably possible. Depending on the circumstances and your rights under applicable law, the appropriate remedy may include repair, replacement or refund. Beyond Geometry may request photographs, video, diagnostic information or return of the product where reasonably necessary to assess a fault. Nothing in these Terms limits any rights or remedies available to consumers under the New Zealand Consumer Guarantees Act 1993 or other applicable consumer protection legislation. Change-of-mind returns are not automatically accepted unless stated in the Shipping & Returns policy or agreed by Beyond Geometry.

9. Digital Products

Where Beyond Geometry sells downloadable files, designs or other digital products, the licence and permitted uses will be stated on the relevant product page or accompanying licence. Unless otherwise stated, purchasing a digital product grants a non-exclusive, non-transferable licence for personal use only. Digital files may not be redistributed, resold, uploaded to file-sharing services, commercially reproduced, or represented as your own work without written permission from Beyond Geometry. Nothing in this section limits rights that cannot legally be excluded under applicable consumer law.

10. Intellectual Property

Unless otherwise stated, the Beyond Geometry name, Flight Station name and branding, product designs, software, firmware, graphics, photographs, written content, digital files and other original material published by Beyond Geometry remain the intellectual property of Beyond Geometry and/or George Gray. Purchasing a physical Beyond Geometry product does not transfer ownership of the intellectual property embodied in that product. You may not reproduce, distribute, sell, commercially exploit or represent Beyond Geometry intellectual property as your own without permission.

11. Website Use

You must not use this website in a way that could damage, disrupt or interfere with the website, its services or another person's use of the website. You must not attempt to gain unauthorised access to the website, customer information, systems, software or other restricted resources.

12. Third-Party Services

Beyond Geometry products and this website may rely on or interact with third-party platforms, internet services, payment providers, data providers and delivery companies. Beyond Geometry is not responsible for outages, changes or failures of independent third-party services outside its reasonable control. Where a third-party service is required for an important Flight Station function, reasonable efforts may be made to maintain compatibility or provide an alternative where practicable.

13. Privacy

Personal information collected through this website is handled in accordance with applicable New Zealand privacy law and the Beyond Geometry Privacy Policy. Information required to process orders, provide customer support, deliver products and operate relevant services may be collected and retained where reasonably necessary.

14. Limitation of Liability

To the maximum extent permitted by law, Beyond Geometry is not liable for indirect or consequential losses arising from circumstances outside its reasonable control. Beyond Geometry is not responsible for decisions made using aircraft, weather or other information displayed by Flight Station. Flight Station data is provided for informational and recreational purposes and must not be relied upon for operational aviation decisions. Nothing in these Terms excludes or limits liability where doing so would be prohibited by New Zealand law.

15. Changes to Products and Services

Beyond Geometry products are actively developed and may evolve over time. Software features, user interfaces and online services may be modified, improved, replaced or discontinued where reasonably necessary. Where a change materially affects a paid service or an expressly promised product benefit, Beyond Geometry will comply with any obligations that apply under New Zealand law.

16. Changes to These Terms

These Terms may be updated from time to time to reflect changes to products, services, business practices or legal requirements. The current version and effective date will be published on this website. Changes will not retrospectively remove rights that have already arisen under an existing purchase or applicable law.

17. Governing Law

These Terms are governed by the laws of New Zealand. If a dispute arises, please contact Beyond Geometry first so that an attempt can be made to resolve the matter directly. Nothing in this section limits any right you may have to use a dispute-resolution process, tribunal, court or other remedy available under applicable law.
